By accessing and browsing this Site, you accept, without limitation or qualification, these Terms and Conditions and shall be bound by it.

The domain name www.eha-health.org is owned and operated by Emmanuel Hospital Association (“EHA” or “Us” or “We”), a society registered under the laws of India, having its registered office at 808/92 Deepali Building, Nehru Place, New Delhi, Delhi-110019, India.

It is to be noted that this Agreement shall not supersede any agreement made in particular, with specific terms and conditions, written and signed between the Emmanuel Hospital Association and the other party(ies).

For purposes of this Agreement, the term “Content” includes, without limitation, information, data, text, logos, photographs, videos, audio clips, animations, written posts, articles, comments, software, scripts, graphics, themes and interactive features generated, provided or otherwise made accessible on or through the Services, including the user-generated content.

ELIGIBILITY

The services are available only to the persons (“User” or “You”) who are eligible to enter into legally binding contracts under applicable law.

PROPRIETARY RIGHTS

That EHA has proprietary rights and trade secrets in the content and information displayed and distributed in this Website and the User is not permitted to copy, reproduce, resell or redistribute such information. We also have rights to all trademarks and trade dress and specific layouts of this webpage, including calls to action, text placement, images and other information.

INTELLECTUAL PROPERTY

That the contents of this Website are a creation of EHA and therefore, is protected by and under the laws of Intellectual Property applicable in India and may not be redistributed, transmitted, copied, reused or modified without the express written permission from EHA for any purpose.

USE OF WEBSITE

The policies regarding the use of this Website and the extent of liability held by EHA has already been disclosed in Privacy Policy. The User is advised to peruse the privacy policy carefully to understand the terms of use of the Website.

PERSONAL INFORMATION

The User shall be solely responsible for the personal information provided on the Website, fully understanding that we only act as a passive conduit for receiving and processing your requests based on the user’s personal information. The information shared by the User concerning Personal Information (or any items listed therein) shall not be false, inaccurate, misleading, or fraudulent.

DONATIONS

All donations made on Website by You shall be in Indian Rupees only. Website will not facilitate transaction in a currency or any other form of currency other than Indian Rupees for the donations made on Website. In making donations on the Website you represent and confirm that the credit/debit card that is being used is yours or that you have been specifically authorized by the owner of the credit/debit card to use it. In cases where the donation transaction is unsuccessful due to any network or technical issue between intermediary, bank or payment gateway, the transaction shall not be processed, and a refund where due will be initiated for the same.

Donation products mentioned on the website are to illustrate activities and the change that your donation can make to the lives of people. Donation raised by Emmanuel Hospital Association go to a pool and resources are allocated to different areas based on the need at the ground.

We shall refund any successful donations already made by You as per the prevailing Refund Policy of EHA.

FUTURE COMMUNICATIONS

By using this Website, sharing your details with us, registering on the Website, by donating or showing interest in making donations for any activity, you also agree to receive communication from us in the form of emails, messages, letters and phone calls. The communications that you receive will pertain to updates about EHA’s work, payment details/ queries, and information. You agree that the same shall not be deemed to be a violation of applicable telecommunication regulations. We will use personal information in accordance with the privacy Policy.

DISCLAIMER OF WARRANTY

EHA makes every effort to provide accurate information, the content provided on the Website is “as is” and EHA makes no warranties regarding the content on the Website. EHA expressly disclaims all warranties of any kind, whether express or implied, including, but not limited to, website content or any reliance upon or use of the website content. Without limiting the generality of the foregoing, EHA makes no warranty:

Users are requested to go through the terms and condition before transacting on these websites. EHA takes not take any responsibility for transactions on the said websites.

LIMITATION OF LIABILITY

EHA will not be liable for any direct, indirect, incidental, special or consequential damages in connection with this Agreement or the products or services in any manner, including liabilities resulting from (1) the use or the inability to use the website content or services; (2) the cost of procuring substitute services or content; (3) any transactions entered into through the Website; or (4) any lost profits alleged by the User.

INDEMNITY

You agree to defend, indemnify and hold EHA harmless against any losses, expenses, costs or damages (including our reasonable attorneys’ fees, expert fees’ and other reasonable costs of litigation or proceedings) arising from, incurred as a result of, or in any manner related to any claim or action based upon (a) your breach of, or failure to comply with, the terms and conditions of this Agreement and/or (b) your use of the Services. EHA may, in its discretion, participate in defence of any such claim or action and any negotiations for its settlement or compromise.

TERMINATION OF USE

EHA reserves the right to terminate the access of this Website for any user if it has reason to believe that the user has breached any term or condition stated herein. Following the termination, the user will not be permitted to use the Website. Further, We also reserve the right to use any lawful means it deems necessary to prevent unauthorized access or use of this Website.    

WAIVER

EHA failure to enforce any provision of the Terms or respond to a breach by you shall not in any way waive EHA’s right to enforce subsequently any provision of the Terms or to act with respect to similar breaches.

ENTIRE AGREEMENT

This Agreement constitutes the entire and final agreement regarding the Website and its contents and supersedes any prior or contemporaneous communications between User and EHA regarding the Website and its contents unless there is an individually signed agreement between the parties.

RESERVED RIGHTS OF EHA

We may discontinue this Website at any time and for any reason, without notice. All rights not expressly granted herein are hereby reserved with EHA.

APPLICABLE LAW

Any dispute arising out of these terms and conditions, user agreement, privacy policy or the documents they incorporate by reference and/or your use of the Website shall be governed and construed in accordance with the laws of India, notwithstanding any conflicts of law.

JURISDICTION

You expressly consent to submit any dispute arising out of these terms and conditions/User agreement to the jurisdiction of courts of New Delhi, India.

CHANGES TO THIS AGREEMENT

EHA reserve the right to revise this Agreement at EHA’s sole discretion without prior notice and at any time. The latest Agreement will be posted here. By continuing to use the Services after changes are made, you agree to be bound by the revised AGREEMENT.
